Lack of Governmental Conscience

I too am ashamed. Ashamed of the absolute farce that has occurred in Canberra in their bipartisan failure to agree on how to manage the influx of illegal immigrants (or boat people). Ashamed that more humans have perished in their attempt to reach our shores. Ashamed that we as a nation have not identified a way that precludes genuine refugees from having to attempt these dangerous passages in their search for a better life.

An Assault on Justice – Follow-up

You will recall in a post on this site that on 25 August 2011, an ambulance crew attended a patient at Kings Cross. During the transport to hospital the patient assaulted one of the attending paramedics. Police attended and the patient was arrested. The case was before the court on Friday 20 January 2012. The Magistrate, Ms Pat O’Shane, after hearing the evidence only of the assaulted paramedic, and not his partner, found in favour of the patient.

I welcome today’s decision by the Supreme Court to set aside that decision, dismiss the case and return the matter to the local court to be heard before a different magistrate. The law is there to protect all frontline paramedics and this decision vindicates our trust in the justice system.

I was angry at the outcome of the original case. On 30 July 2010, new protection for paramedics against being assaulted became legally binding.  This legislation was to confirm to the community that verbal and physical assault would not be tolerated.  All paramedics should know they can undertake their on-road clinical duties unhindered and appropriately protected against assault.

The Director of Public Prosecutions is to be applauded for appealing the original decision and I look forward to the case being re-heard at a later date.

It is absolutely paramount for all paramedics to report every incident of violence or aggression either verbal or physical.  The Ambulance Service of NSW on record as stating it will pursue all individuals who cause harm to paramedics with the full force of the law.

Japanese earthquake and tsunami – one year on.

With a minute of silence, tolling bells and prayers, on Sunday, Japan will mark the first anniversary of an earthquake and tsunami that killed over 20,000 people and set off a nuclear crisis that shattered public trust in atomic power management and the nation’s leaders.

A year after the magnitude 9 earthquake unleashed a 23m wall of water that hit Japan’s northeastern coast, killing nearly 16,000 and leaving nearly 3,300 missing, the country is still grappling with the human, economic and political costs.

In coastal communities, police and coast guard officers, urged on by families of the missing, still search rivers and shores for remains even though the chances of finding any would appear remote. Without bodies, thousands of people are in a state of emotional and legal uncertainty.

All across Japan a moment of silence will be observed at 14:46 (05:46 UTC) when the quake struck and then again, 33 minutes later when a 23m wall of water hit coastal communities.

A “bell of hope” will toll in Ofanato and mourners will sail out to sea to release lanterns.

The Japanese people earned the world’s admiration for their composure, discipline and resilience in the face of the disaster while its companies impressed with the speed with which they bounced back, mending torn supply chains.

However, in terms of the human toll, the recovery will take a lot longer as the Japanese people struggle to come to terms with their grief after having lost family members, friends, neighbours.  The psychological impact of such loss is incalcuable.

Church Bans Inter-Racial Couples

A small Baptist church in eastern Kentucky has voted to ban inter-racial couples from joining the congregation and from taking part in all church functions other than funerals.

The vote to ostracise inter-race couples was held at the Gulnare Free Will Baptist church last Sunday. It has prompted a bitter dispute in the local Pike County and thrown up hatreds and antagonisms that had been hidden beneath the surface of the community for years.

The vote was held on a motion brought by the former pastor of the church, Melvin Thompson. He proposed people in inter-racial marriages should not be ”received as members nor will they be used in worship services and other church functions with the exception being funerals”.

His motion added that it was ”not intended to judge the salvation of anyone, but is intended to promote greater unity among the church body and the community we serve”.

Mr Thompson’s move originated from a church service in June attended by Stella Harville, 24, and her black fiance, Ticha Chikuni, 29. Ms Harville, a pianist, accompanied Mr Chikuni as he sang a hymn.

On August 7 Mr Thompson, still pastor at that point, approached Ms Harville’s father, Dean, who is secretary and treasurer of the church. ”Thompson told me Stella and her boyfriend were not allowed to sing in the church any more,” Dean Harville said. Mr Chikuni is originally from Zimbabwe. He has lived in the US for 11 years.

When Mr Thompson’s motion was put to the vote nine members registered in favour of it and six against, with about 25 parishioners leaving the church before the ballot was called.

For the Love of God? I think not.

Captain Coward?

Cast your minds back to the recent capsizing of the MV Costa Concordia off Isla d’Giglio.

There are two schools of thought as to the actions of the captain, Francesco Schettino.

There are those who consider his actions of those of a coward who jumped – sorry, “slipped and fell” – into a lifeboat and promptly made his way to the shore of the island, where he was more interested in hailing a taxi to take him into town to buy dry socks, than he was in remaining on – or returning to the stricken vessel to ensure that the passengers were safely rescued from the vessel.

 

He ignored the directive of the Italian Coastguard commander to “Vada a bordo, cazzo!” – loosely translated to mean “Get on board, you prick!”, and “Don’t make any more excuses”, he got to shore as fast as was humanly possible.

It seems that the ship’s doctor and the purser took the lead roles in getting as many people to safety as they possibly could, after Schettino absolved himself of that responsibility.

Conversely, he still insisted he had ‘saved thousands of lives’, by steering the vessel onto the rocks to prevent it from sinking, although he admitted he had made a mistake by sailing so close to the island of Giglio tearing a long gash in the hull of the Concordia.

The whole idea of going “down with the ship” shouldn’t be taken lightly however. It is an antiquated and romantic ideal without basis in law. Legally or morally, self-sacrifice is a tough thing to expect of someone, regardless of his position. Would Schettino’s presence on the capsizing vessel have even made a difference? Time will tell, but his choosing to leave the ship could have been an entirely practical decision. He was not obligated to drown out of some perverse, old-fashioned sense of duty.

Schettino asserts that Costa Cruises management was always telling him ‘pass by there, or pass by there’. Now I’m paying for it,” Schettino states during a telephone conversation in the hours after he was arrested.

But it appears that recordings back up claims by the captain that the cruise company in fact encouraged the practice, because it was went down well with passengers in the increasingly competitive cruise ship business.

The captain’s conversation was covertly taped when he was held in a police station in Orbetello on the Italian mainland, after being arrested on Giglio in the hours after the chaotic evacuation of the giant ship.

It is alleged he stated on a mobile phone: “When I realized that the ship was listing, I left and got off it.”

Schettino, who has been dubbed ‘Captain Coward’ by the Italian media, insisted that once a huge rip had been torn in the multi-million euro ship and water began flooding into its engine rooms, “I did my best to “alleviate” a desperate situation” Schettino stated,

Irrespective of the actions of Schettino, the responsibility for the sinking of the vessel also rests with the owners Costa Cruises and they should expect a multi-billion euro law suit or class action to follow. Itwas announced today that Miami-based Carnival’s Italian unit reached a damage- settlement agreement with many consumer groups last week as the company was sued in Miami and Chicago. Insurance costs for the accident may reach US$1 billion once environmental damage and injuries are tallied.

Genoa-based Costa Crociere agreed to pay 11,000 euros ($14,500) to every passenger of the cruise, plus reimburse expenses including the cost of the cruise.

The sail-by at Giglio could well spell the end of Costa Cruises!

Politicians

Have you ever wondered why as a group of people, politicians leave themselves so readily open to ridicule. Take one look at the current batch of Australian federal politicians for a moment.

We have a minority government, with the balance of power held by a few independent cross-benchers. The Australian Labor Party didn’t so much as lose the last election rather than the Liberal coalition, a party in complete disarray without a viable and effective leader since the demise of John Howard, failed to win it. Remember John Howard? History will record him as one of the few sitting Prime Ministers ever to have lost his seat at a general election; and to a first time novice candidate.

Anyway, here we have this minority Labor government. What a strange group they are too. There’s Craig Thompson. He is being investigated by police for alleged fraud and credit card irregularities. The alleged attempt to disguise payments to a Sydney-based escort agency undermines Mr Thomson’s recent claim that his signature was forged when he was Health Services Union boss. In further damaging evidence, court documents conclusively show his mobile telephone was used to contact escort agencies recorded on his credit card. They also show he tried to phone two other escort agencies that have not been previously revealed. The Opposition yesterday tried to force Mr Thomson to front up to Parliament to answer claims he used a union credit card to pay for prostitutes. But the Gillard Government, which would likely fall if he is forced to resign, blunted the attack. If a majority government existed, Mr Thompson would have long ago been dismissed. But no, he appears to be a protected species – at least for the time being.

Then there is the Prime Minister herself. Ms Gillard born in Barry in Wales, she has a peculiar accent that is neither Australian nor Welsh. She is a redhead with pale skin and a prominent nose. This persona is a cartoonist dream, thus she often wears the brunt of the cartoonist’s pen. She lives in de facto relationship which is possibly not the best example for a head of state to set, especially when moving and travelling in conservative Christian and Islamic circles.

Then there’s Peter Slipper. Magnificently poached from the Opposition after 21 years as the Liberal member for Fisher in Queensland. How did the government achieve this feat and boost heir numbers by one? Easy, offer him the position of Speaker of the House. This position is usually held by a member of the government – but not always. As a result of this treachery, Peter resigned from the Liberal party and became an independent for Fisher – at least until the next election – where his constituents will probably repay him for that treachery.

There is well known adage that states that a politicians only job is to get re-elected, and they thank God they only have to do that once every three or four years! Long enough for people to forget their past stupidities.

Speaking of re-election and looking wider afield, consider the former polkovnik (colonel) of the Communist KGB who overnight converted to democracy to become the second President of Russia, Vladimir Putin. Because of constitutional mandated term limits, Putin was ineligible to run for a third consecutive presidential term. After the victory of his successor, Dmitry Medvedev in the 2008 presidential elections, Putin was nominated by Medvedev to be Russia’s Prime Minister. Putin took office on 8 May 2008. Not satisfied with this, and with a lust to remain in power, in September 2011 Putin officially announced that he would seek a third, non-consecutive term in the 2012 presidential elections. What do you do when the constitution forbids another term? You change the constitution! His intention to circumvent the constitution and prolong his rule, proved extremely unpopular with Russian people, and was believed to be a cause of the 2011 Russian election protests. He appears not able to exist without the elixir of power. Oh dear!

Having said all this – who are the bigger fools? The politicians with their antics and their grab on power, or we the electorate who put them there?

Finally, how do you tell when a politician is lying? Their lips are moving!

An assault on justice?

I am a serving paramedic. I fail to understand the decision by Magistrate Pat O’Shane when dismissing charges against a man accused of assaulting a paramedic recently. A paramedic must be able to move freely without further risk to personal safety. The job brings with it, many inherent risks to a paramedic’s well-being, safety and welfare, both physical and psychological. The NSW government recently enacted legislation to protect paramedics and to ensure prompt and effective action against those in society who would assault them. To assault a paramedic wilfully and knowingly now carries the same penalty as assaulting police. Ms O’Shane’s recent decision to aquit the accused beggars belief and only compounds the view – with some – that it is OK to assaultt paramedics. She is mistaken. It is NEVER acceptable behaviour. This is not the first time that this magistrate has been involved in dubious judicial decisions and actions. The magistrate refused to hear corroborating evidence from the paramedic’s own work partner. I will follow the judicial review of her activities and preformance with interest. I am happy to say that this case has brought bipartisan government support to the paramedics involved and also support from executive ambuance mangement. The police are preparing an appeal against the decision of the Court.
